Terms of Service
1. Acceptance of Terms
By creating a Kreo account or using any Kreo service, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use Kreo. These Terms constitute a legally binding agreement between you and Kreo Technologies Private Limited ("Kreo", "we", "us").
2. Eligibility
- You must be 18 years of age or older to use Kreo
- You must be a resident of India or operating within Indian jurisdiction
- You must have a valid Instagram Business/Creator account or a YouTube channel in good standing
- Your account must comply with Meta's and Google's own terms of service
3. Creator Accounts & Responsibilities
As a creator on Kreo, you agree to:
- Provide accurate information when setting up your profile and payout details
- Only promote products/links that you genuinely recommend or have experience with
- Comply with ASCI (Advertising Standards Council of India) guidelines for disclosure of paid partnerships and affiliate links
- Not use Kreo to promote illegal products, counterfeit goods, prohibited financial products, or adult content
- Not attempt to artificially inflate click counts or conversion metrics
- Not reverse-engineer, scrape, or abuse Kreo's systems
4. Affiliate Links & Commissions
- Kreo converts your links into tracked affiliate links using cookies and server-side redirects
- Commission rates are set by the affiliate networks (Amazon, Flipkart, Myntra, etc.) — not by Kreo
- Kreo earns no commission from your affiliate income during your first ₹10,000 of lifetime earnings on the Free plan
- After the ₹10,000 milestone, Kreo deducts 8% from your confirmed earnings if you remain on the Free plan
- Pro plan subscribers (₹499/month) pay 0% commission on all earnings
- Earnings shown as "Pending" reflect orders not yet confirmed by the affiliate network. Kreo does not control confirmation timelines
5. Payouts
- Payouts are made every Friday for confirmed earnings above ₹100
- You must provide a valid Indian UPI ID or bank account + IFSC code
- Kreo uses Razorpay as its payout processor. Payouts are subject to Razorpay's own processing terms
- We are not liable for delays caused by banking systems, incorrect payout details provided by you, or force majeure
- Earnings may be withheld if we detect fraudulent activity or a violation of these Terms pending investigation
6. Instagram DM Automation
- This feature uses the Meta Graph API and requires your explicit authorisation
- You are responsible for ensuring your use of DM automation complies with Meta's Platform Policy and Instagram's Community Guidelines
- Kreo will not send DMs on your behalf to users who have not triggered an automation by engaging with your public content
- Abuse of DM automation (e.g., mass unsolicited messaging) will result in account suspension
7. AI Video Studio
- You retain full ownership of all video content you upload
- By uploading a clip, you grant Kreo a limited, temporary licence to process that clip for the purpose of generating your edited video
- Processed clips are deleted from our servers within 24 hours
- Free plan: 3 AI video edits per calendar month. Pro plan: unlimited
- You must not upload content that violates third-party copyright or human dignity
8. Intellectual Property
You retain ownership of all content you create. Kreo retains ownership of its platform, branding, technology, and the Kreo name. You grant Kreo a limited licence to display your storefront publicly and use your publicly stated creator name and profile picture in Kreo marketing (e.g., "Creators using Kreo") — you may opt out by emailing legal@kreo.in.
9. Termination
Either party may terminate the agreement at any time. You may close your account via Settings → Account → Delete account. Kreo may suspend or terminate your account immediately for violations of these Terms. Upon termination, your public storefront will become unavailable. Confirmed but unpaid earnings will be paid out in the next regular payout cycle unless the termination is due to fraud.
10. Limitation of Liability
Kreo's total liability to you for any claim arising from use of the platform shall not exceed the total fees paid by you to Kreo in the 3 months preceding the claim. Kreo is not liable for: affiliate network commission rate changes, Instagram or YouTube API downtime or policy changes, Razorpay processing failures, or loss of earnings from DM automation restrictions imposed by Meta.
11. Governing Law
These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka, India.
12. Changes to Terms
We will notify you 14 days in advance of any material change. Continued use of Kreo after that date constitutes acceptance.
